Juan G. Silva has been in prison more than a year for a crime he didn’t commit.
He will likely be freed next week, not because DNA proved him innocent, but because he admitted he falsely confessed to a fatal 2013 hit-and-run to protect the now-alleged driver — his son.
The costly ruse, which one of Silva’s attorneys characterized as something out of Shakespeare, ended Thursday when prosecutors filed new charges against the 22-year-old son, also named Juan G. Silva.
The younger Silva faces three felonies in the fatal crash on Sept. 28, 2013, when a white GMC van barreled into a pair of pedestrians outside Ela de Copas Tavern near the 1200 block of W. National Ave., killing one and seriously injuring the other.

Between July 1 and July 23, there were 781 hit-and-run crashes in Austin alone. Of those cases, 35 were failure to stop and render aid—meaning someone was injured in the crash. So far, 16 of the July cases have resulted in arrests. In June there were 1,078 hit-and-run crashes and 23 arrests. It’s a tremendous case load and it’s all up to three detectives.
“It’s a very big problem,” explains Austin Police Detective George Burbank.

A Southeast Portland woman who sustained serious injuries July 4 after being struck by a vehicle has died, police said.
Mary Popps, 60, died Tuesday, the Portland Police Bureau said in a news release.
Graphic video footage released earlier this month shows a vehicle striking Popps, causing her to flip in the air, at Southeast 60th Avenue and Holgate Boulevard. The vehicle appears to be a two- or three-wheel motorcycle.

PHILADELPHIA (CBS) — A Philadelphia judge today denied a defense request to reduce bail for an 18-year-old from North Philadelphia who is charged with failing to stop after hitting a bicyclist last month on the Temple University campus, leaving a student critically hurt.
Earlier today, the young driver, Rashan Roberts, waived his preliminary hearing, and there are indications he is likely to plead guilty.
Defense lawyer Michael Hanamirian says his client and his family are hoping the victim makes a full and complete recovery, and they did not want to put her family through the stress of a court session.
“He’s inclined to own up to all of the responsibilities he has under all of the circumstances,” Hanamirian notes.

Mariah Eccleston of Greece pleaded guilty to leaving the scene of a fatal accident. She hit and killed Joseph Pacheco on Howard Road back in August. The victim was walking home from a local donut shop when he was struck down less than 100 yards from his home.

Channel 2’s Tom Jones asked Russell if he was guilty of the charges. “No, I’m innocent,” he replied. When asked why people should believe him, he said, “Because I’m innocent.”

A Veneta woman on Friday backed out of a plea deal that would have sent her to prison for allegedly pulling a gravely injured man’s body off her car and leaving him to die more than a mile from the spot in Springfield where her vehicle struck him last December.
Isabel Gloria McDaniel, 31, told Lane County Circuit Judge Maurice Merten during a scheduled hearing in which she was to plead guilty that she was “not ready to proceed” because she and her defense team “don’t have all of the information (they) need” to finalize a plea agreement with prosecutors.

On July 1, cell phone video captured the aftermath of the collision that killed 26-year-old Luis Rodriguez, who was killed in a hit-and-run on the Florida Turnpike, in the Kendall area, after he fell off his motorcycle. He left behind a 2-year-old son, Tyler.
On Monday morning, his mother, his sister, his fiancée and the young son they had together, all gathered at their attorney’s Downtown Miami office to make a plea to the public for anyone who may have seen anything to come forward to help police in their investigation. “I just want answers,” said Mariana Cruz, the victim’s fiancee, “so I can be able to tell my kids what happened to their dad because it’s not fair to leave him, to just have left him there, and not be able to get the family that closure.”

BAY MINETTE, AL – Justin Lott received the maximum sentence of 20 years in prison for manslaughter in a fatal hit-and-run accident that claimed the life of spring breaker Kasey Waychoff in March of 2014.
He was also sentenced to 10 years for leaving the scene of an accident causing injury or death and one year for assault for a total of 31 years. Each term is the maximum allowable under state guidelines for those offenses.
