WILKES-BARRE — The state Supreme Court has agreed to decide whether prosecutors had the right to seize a vehicle from the driveway of a hit-and-run suspect without a warrant, further delaying a high-profile case that has gone on for nearly four years.

Daniel Loughnane, 43, of Hanover Township, is facing hit-and-run charges over the death of Rebecca McCallick, 19, after she was run over on Hazle Street in Wilkes-Barre on July 24, 2012. Prosecutors allege he struck McCallick, who was high on marijuana and lying in the street, while on his way home from the Gentleman’s Club 10 strip club in Wilkes-Barre Township.

The trial, which had been slated to begin in March 2014, has instead suffered lengthy delays because of appeals by both sides related to key evidence in the case. A central issue has been whether police illegally seized his Ford F-350 Super Duty Diesel when they confiscated it without a search warrant on Aug. 9, 2012.
